1. Acceptance of Terms
By accessing or using AlgoBanana services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms apply to all plans — DeskBot, AutoPilot, and AlgoEngine.
2. Description of Service
AlgoBanana provides technical automation infrastructure for executing trading strategies. We are not a financial adviser, broker, or investment manager. We do not provide trade signals, investment advice, or any guarantee of profitability. All trading decisions remain solely yours.
3. Eligibility
You must be at least 18 years old and legally permitted to engage in financial trading in your jurisdiction. By using our services, you confirm that automated trading is lawful in your country and that you have the necessary permissions from your broker.
4. Payment Terms
Pricing is quoted on a per-project basis. A payment link is sent after an initial discovery call. Work begins only once payment is confirmed. All fees are non-refundable once work has commenced, unless otherwise agreed in writing. Custom quotes (AlgoEngine) are scoped individually and confirmed before any payment is requested.
5. Ownership of Deliverables
Upon full payment, you own all code, configurations, and infrastructure we build for you. AlgoBanana retains no ongoing rights to your strategy, algorithm, or brokerage account. You are free to modify, transfer, or discontinue use of the delivered system at any time.
6. Your Responsibilities
You are solely responsible for: (a) the design and logic of your trading strategy; (b) configuring appropriate risk limits; (c) monitoring your live system; (d) ensuring your broker account has sufficient funds and permissions; and (e) complying with all applicable laws and regulations in your jurisdiction.
7. Risk Acknowledgement
Automated trading involves significant financial risk. Losses can exceed your initial capital. Technical failures, connectivity issues, or market conditions may cause missed trades or unintended executions. By using our services, you acknowledge and accept these risks in full.
8. Limitation of Liability
AlgoBanana shall not be liable for any trading losses, missed trades, technical failures, or any direct, indirect, incidental, or consequential damages arising from the use of our infrastructure. Our total liability in any circumstance is limited to the amount you paid for the specific service in question.
9. No Custody of Funds
AlgoBanana never holds, manages, or has access to your trading capital. Your funds remain with your broker at all times. We only interact with your broker account via API keys you provide, solely for the purpose of executing your configured strategy.
10. Confidentiality
We treat your strategy details, configuration, and personal information as confidential. We will not share your information with third parties except as required by law or as necessary to deliver the service (e.g. cloud hosting providers).
11. Termination
Either party may terminate the service relationship at any time. Upon termination, all deliverables already paid for remain yours. No refunds are issued for work already completed. We reserve the right to refuse service to anyone at our discretion.
12. Modifications to Terms
We may update these Terms of Service from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We will notify active clients of material changes via email.
13. Governing Law
These terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to binding arbitration or the courts of the jurisdiction in which AlgoBanana operates.
